The legal situation

Dashcams were developed for use in road traffic and are even mandatory in some countries. In Germany, however, the right to privacy has priority, which is why dashcams try to impair this as little as possible. This should be achieved with only short recordings that are overwritten one after the other when the storage space runs out. This is not legally completely watertight either, but it is a good compromise solution. In road traffic, dash cams have further advantages over action cams due to the fixed power supply.

Filming in private rooms and for private purposes is permitted, for example with your own family or with friends (each with consent). It is also allowed to record and publish landscapes or your own sports “Exploits”, as long as no other persons and their rights are affected. Using a camera in road traffic, on the other hand, violates Section 6b of the Federal Data Protection Act, since the data of other road users are recorded without being asked in public traffic areas and thus outside of private areas. However, this right to informational self-determination on the part of other road users is also opposed to the interests of the filmmaker – at least if they want to prove their innocence after an accident. In this case, he can refer to the Basic Law (e.g. Art. 2.2 and Art. 103.1); his right to a fair hearing prevails, i.e. a substantive assessment of his point of view in court. For this purpose, material recorded by a camera can also be used – with the somewhat curious consequence that the film material is admitted as evidence for the end of the film, but at the same time he can be subject to a not inconsiderable fine. Under the principle of establishing the truth, unlawfully filmed material can therefore be taken into account – but also against the end of the film, for example when speeding is exceeded.

Data, facts & Terms

The products have terms such as inch, 4K60, 1080p, 20 MP, 120 fps, Mbit / s, and H.265. But what does it mean in each case and what should you pay attention to when buying? First of all, there is this Sensor size: The specification 1 inch (= 1 inch = 2.54 cm) refers to its diagonal. The Insta360 1-inch has the largest sensor, the GoPro is 1 / 2.3 inches, i.e. 1.1 cm. Larger sensors do not necessarily offer higher resolutions (in Megapixels, MP), but tend to have lower noise images in low light. A good sensor can also capture larger light-dark differences. For a good image quality, it is also given in Mbit per second Bit rate important (100 Mbit / s are now up to date), as well as File format and codec, in which the video will be saved. MP4 with the compression H.264 or space-saving, but also computationally intensive H.265 is common. 4K stands for the resolution: The higher the resolution, the more details can be displayed. A combination such as 2.7K120 adds an indication of the resolution to the resolution frames per second (fps). The camera should be able to at least 60 fps.

Conclusion

We got two main lessons. First: Expensive action cams often have higher quality technology, which is why they do better in the test. Second: GoPro is rightly the industry leader. Experience and the closeness to extreme athletes are noticeable in the range of functions and in the detailed solutions. The lead in terms of image and sound recording, image stabilization and operation are remarkable. Unfortunately, the cheap Phantom 4K showed weaknesses with its lavish accessories, otherwise it would have ended up high with its great image quality.

The three dashcams all do a good, reliable job. If you want a dashcam despite legal concerns, you can’t go wrong with all three.
