Kumpan Electric wanted to present the 100 km / h version of the 1954 Ri Sport electric scooter at EICMA 2018. Piaggio itself celebrated its world premiere with the Vespa Elettrica.

As Kumpan Electric announced in a statement, Piaggio wanted to have the vehicles transported directly to them. Instead of just securing one vehicle for inspection, contrary to the usual procedure, all Kumpan scooters were taken away by Piaggio at the request of the customer.

Patent Office rejects Piaggio application

At the same time, in November 2018, Piaggio filed an application for the nullity of the design of Kumpan Electric with the European Intellectual Property Office (EUIPO). Piaggio believed that Kumpan scooters “not new” be and none “Peculiarity” would have. After almost two years of examination and evidence, the EUIPO has completely rejected Piaggio’s application.

This means that the protection of the design of the Kumpan 1954 Ri model remains. Among other things, the office relies on the fact that the design freedom in the design of a motor scooter is limited as it has to have two wheels, a seat, handlebars, a protective shield and a cover for the engine. Kumpan emphasizes that the 1954 Ri model has enough features to set it apart from other sellers. Piaggio now has eight weeks to appeal against the rejection of the application.

Conclusion

The Vespa is without a doubt a scooter icon. Accordingly, Piaggio tries again and again to denounce other scooter manufacturers as brazen copiers. But as the patent office has established, a scooter has a certain basic shape. Therefore, not every scooter is a Vespa copy.
