A driver flashed by a radar at more than 100 km / h in the city was released by the Montpellier Court of Appeal, on the grounds that nothing proved that the radar had been well positioned, we learned on Friday from the driver’s lawyer, confirming information from the daily Midi Libre.

"This is a first in France to my knowledge and it should set a precedent", told AFP Me Jean-François Reynaud, who is involved in several other cases of the same order.

Truck driver by trade, the driver from Sète (Herault) was sentenced by the police court to lose the last three points of his driving license after being flashed by a mobile radar at 104 km / h on a four- Montpellier lanes limited to 50 km / h (avenue de Toulouse).

Before the court, the lawyer had pleaded that "the public prosecutor did not demonstrate the regularity of the installation of the Mesta 210 mark radar which recorded the offense".

The Court of Appeal therefore accepted the argument of the lawyer and pronounced the discharge with the benefit of the doubt, considering that "nothing proves that these rules of positioning were indeed respected".
