The compulsory night vest for cyclists !
By a decree dated July 30, the government makes it compulsory to wear a high visibility vest for any cycle driver traveling at night or when visibility is insufficient. Bikers are therefore not affected.
In the highway code, article R. 431-1 stipulates that "any driver or passenger of a motorcycle, motor tricycle, motor quadricycle or moped must wear an approved type helmet", the law leaving these road users free to equip themselves or not with gloves, jacket, pants or underpants…
From now on, this compulsory wearing of a helmet is supplemented by the wearing of a "high visibility vest". But unlike the helmet -"cap", specifies the text, by bikers and"driver or passenger of a motor tricycle, motor quadricycle or moped"-, the vest, must be worn by cyclists and this, in – hum – precise conditions !
In fact, just after article R. 431-1, article R. 431-1-1 is inserted into the highway code as follows:
"Art.R. 431-1-1. – When driving at night, or during the day when visibility is insufficient (to be determined with the police on site? Editor’s note), all drivers and passengers on a cycle must wear a high-visibility vest outside built-up areas that comply with regulations and whose characteristics are provided for by an order of the Minister responsible for transport".
Thus, drivers of motorcycles (two motorized wheels over 50cc) and mopeds (two motorized wheels under 50cc) are not affected by this new article. !
Let us specify all the same to our readers who practice the bicycle that "the fact for any driver or passenger of a cycle to contravene the provisions of this article is punished by the fine provided for the contraventions of the 2nd class". Either the same rate as for offenses such as" driving on an emergency lane "or" a major change of direction without prior warning ": a fixed fine of € 35 (reduced by € 22).
This measure will come into force as of October 1, 2008. Cyclist friends, take your yellow jerseys so ?
