If, in the course of an accident caused during a test drive, it turns out that the test driver does not have a driving license, the insurance company may, under certain circumstances, refuse to compensate for the damage incurred and you may also face criminal penalties for allowing driving without a driving license. You should also make sure that the liability insurance you have taken out does not have any restrictions with regard to the driver of the vehicle. If the insurance is only issued to you as a solo driver, the journey of a prospective buyer constitutes a breach of obligation, which in the event of an accident caused by fault can lead to recourse claims on the part of the insurance company. The prospective buyer is liable for all damage caused during the test drive. This includes not only all damage to the motorcycle, but also upgrading damage to fully comprehensive insurance as a result of an accident. It is irrelevant whether the buyer scratches the tank or causes a total loss of the motorcycle. If you want to be on the safe side, you should always call a witness when selling. If there are later disputes, he can testify to the condition of the motorcycle before and after the test drive. And: Have a deposit handed over to you before the test drive, preferably your identity card. The data from the identity card and the time of handover of the motorcycle in the event of a sale should also be documented on the purchase contract.
