Police checks are probably not something that anyone would choose as a hobby. A few rules of conduct can be internalized so that the involuntary stop does not last longer or become more expensive than necessary.

It is a truism that we motorcyclists sometimes overlook a road sign with a speed limit and then drive faster than allowed. Also that one or the other ignores it to let the pig out for a moment – nobody is looking anyway.
If someone peeps and threatens a fine including Flensburg points, it’s time to keep calm, be friendly, hold back. Police officers are just people doing their job. So there is no reason to be sluggish – unless you can tolerate the echo. And vice versa: Those who are friendly are usually treated that way. This saves time, nerves and even money for those who are controlled.
Just don’t suggest any premeditation!
Anyone who knows that they have interpreted the rules of the road traffic regulations a little too freely can and should keep quiet about it. Everyone is entitled to this and, if the worst comes to the worst, it helps to save a lot of money.
Because of the intent clause, which has been in force since February 2009, certain traffic offenses that were committed intentionally cost twice as much as if they were accidental, i.e. negligent.
The apparently harmless statement that one drives the route every day can lead to the assumption of the intention. The legislature concludes from this that one must know the speed limits.

We quote the official: “Even if I appear as a police officer, I am still a normal person and behave like that. And that’s why I expect everyone, including someone I’ve just stopped, to behave like a normal person towards me. This includes speaking politely to each other, taking off your helmet and sunglasses – of course I do that too. By turning off the engine and getting off the motorcycle, you signal that you are ready to talk.

One should realize that the issue at stake in such a situation are facts in the form of one or more traffic violations. I can prove this with the help of the measurement and recording technology integrated in the motorcycle. So nothing can be argued away. Especially when I have a less experienced driver in front of me, I like to show him on the spot what he has done wrong. Of course, nobody is obliged to make any statement on the matter. It is a legal right not to incriminate yourself.
But even such a rejection can be formulated politely, then everything is okay. And you can still comment on the matter after receiving the notice of the fine. I don’t get involved in any discussion, after all, a meaningful, instructive conversation is not possible in this situation. However, this rarely happens.
I have to say that the vast majority, over 90 percent of motorcyclists, are reasonable. I’ve only had one person in the past five years who immediately switched to stubborn. The majority of motorcyclists have also become more cautious in their driving style. Nevertheless, the number of accidents has risen. This shows that the police must continue to be active with controls.”

At the beginning of 2009, the penalties for deliberately committed traffic violations were reorganized in the German Ordinance on Fines Catalog (BKatV). On the one hand, a separate section in the catalog of fines has been created for certain violations, which by their very nature can only be committed deliberately – sometimes with high fines.
For example, if you get involved in a race with another motorcyclist, you now risk 400 euros and a month’s driving ban. The assumption of the resolution is understandable: nobody has taken part in a race by mistake.
In addition, Section 3 (4a) of the BKatV stipulates that every deliberate traffic violation is subject to a double fine. This currently applies (as of 2017) to all violations of Section I of the BKatV with a minimum fine of 55 euros. If you drive too much at 31 km / h outside of a built-up area, you normally pay 160 euros. In the case of an intentional violation, 320 euros are due.
However, the authority or the inspecting officer must initially assume that the inspection was negligent. Thus, in the event of a control by the police or in a hearing sheet, the decisive factor is which information is provided. The classic excuse “I know I was too quick, but I have an urgent appointment” then leads to exactly the opposite of the desired success. You admit that you knew the speed limit and still didn’t stick to it.
The same thing can happen if you excuse the worn tires by saying that new ones have already been ordered. Not least because of such statements, in later court proceedings in which a decision is to be made on the fine and / or the driving ban, your own information is listed as evidence.
The following applies to controls: “Speech is silver, silence is gold.” As a suspect, apart from personal data such as name, address, date of birth and place of birth, one does not have to give any or no truthful information to the police officers. The officers must provide information about this right to refuse to testify. However, it is hardly worthwhile to invoke your rights because you exceed the speed limit of 10 km / h. Then it can happen that the officers look very carefully for that very reason.
Here it is often better to be friendly and not deny the mistake. Especially in the case of minor traffic violations, it is at the discretion of the officials whether they only issue a verbal warning or issue a warning fine. The following principle often applies here: “As one calls into the forest, it resounds.”
