After the Federal Cabinet and the Federal Council, in October 2019 the Bundestag, on the initiative of the Minister of Transport, approved a general lowering of the entry age from 16 to 15 for the moped driving license. A new law will allow this in future in all federal states.

Since 2013, young people in the eastern federal states have been able to acquire the AM driving license class (scooters and mopeds up to 50 cubic meters, max. 45 km / h) from the age of 15 instead of 16 years.

The experience from this experiment, which ran up to 2020, was so positive that the federal government decided at the end of 2019, at the initiative of the Ministry of Transport, to generally lower the starting age from 16 to 15 years for the moped driving license. The new regulation is intended to make it easier for young people to go to school or training places, especially in structurally weak regions.

Numerous federal states followed suit

However, it was left to the individual federal states whether or not to implement this option. So far, 11 federal states have allowed the youngsters to enter the motorized two-wheeled world earlier. These include Bavaria, Brandenburg, Hesse, Mecklenburg-Western Pomerania, North Rhine-Westphalia, Rhineland-Palatinate, Saarland, Saxony, Saxony-Anhalt, Schleswig-Holstein and Thuringia. Problem: Anyone who lived near the border at the age of 15 and drove into a 16-year-old federal state became a criminal offense because they were driving without a driving license.

New law creates clarity

In order to create clarity in these borderline cases, the Federal Ministry of Transport submitted a draft law that is supposed to regulate driving with 15 nationwide uniformly. The Federal Council approved this on May 28, 2021. According to this, young people in all federal states can now acquire a class AM driver’s license at the age of 15 and thus legally drive nationwide up to their 16th birthday. However, this only applies in the German federal states; driving with the changed key number 195 is not permitted in other European countries.
