Moto Taxi France on appeal against the Federation of provincial taxis
Sentenced last year by the Nice court to suspend its motorcycle taxi activity, Moto Service Côte d’Azur changes lawyers on appeal. Or when a new and interesting idea meets up with a powerful conservative lobby…
The quarrels between the motorcycle-taxi company Moto Service Côte d’Azur and the very powerful French Federation of Provincial Taxis (FFTP) continue…
We remember that on October 12, the Nice Tribunal de Grande Instance referred by the FFTP condemned Moto Service to "cease the use of the name "Moto Taxi France", to cease its activity of transporting people and parcels, to cease the distribution of leaflets with mention of this name and of this activity, and to withdraw advertising from its website mentioning the name Moto Taxi France and its activity", all accompanied by a fine of 1500 FF per day…
Based on the law n ° 95-66 of January 20, 1995 which defines the "Taxi" like a "motor vehicle", taxi operators considered themselves victims of"unfair competition"causing them a"serious damage"Bruno Bonelli, manager of Moto Service, immediately appealed the decision, but his case was found."removed"the role of the Aix-en-Provence Court of Appeal for obscure procedural reasons.
While he has just changed lawyers, he explains to Moto-Net that his case is "waiting on the desk of Mr. Dragon, president of the Aix Court of Appeal, for four months now … Taxis are very powerful you know. And in the meantime, my company is completely paralyzed. However, I registered without any problem the brand "Moto Taxi France" at the National Institute of Intellectual Property (INPI)…".
In addition, before starting its activity, Moto Service Côte d’Azur had made inquiries with the prefecture of Var and that of the Alpes-Maritimes, which had both confirmed that the regulations relating to taxis did not apply to motorcycle passenger transport…
But taxi operators do not seem decidedly willing to share the pie of local urban transport with anyone, since the Bordeaux Taxi Union is also considering legal action against the town hall of Bordeaux over future electric shuttles in the city center..
We now understand why, with the exception of Elysees Moto in Paris, motorcycle taxi companies are still so rare in France while they are developing throughout Europe….
