What is the legal situation?

Unauthorized removal from the scene of the accident, commonly known as accident escape, is a criminal offense. But what is the legal situation if the accident happens on private property?

The crime of escaping by accident can only be committed in public traffic, not on closed-off terrain. This was decided in October 2016 by the Arnsberg Regional Court (Az. 2 Qs 71/16). In the specific case, a driver damaged a company’s roller shutter and left the scene without leaving his or her personal details and taking care of the damage of 2,800 euros. He was identified and lost his driver’s license before the criminal trial. Wrongly, see judgment.
